But first thing’s first.

What is foreclosure?

Foreclosure is an auction which occurs when the homeowner fails to pay the mortgage. If it can’t be sold at an auction, it becomes a part of the lending institution.

Types of foreclosure

Zillow identifies two types of foreclosure - judicial and non-judicial. In Texas, your foreclosure is most likely a Non-Judicial Foreclosure. NOLO does an excellent job of explaining the Texas foreclosure process.

Non-Judicial Foreclosure Process (In Texas)

  • A deed of trust conveys an interest in real property to a third party (your lender/bank) to hold as security for repayment of a debt.
  • Once you go into default by becoming behind on your mortgage payments the trustee is able to begin the foreclosure process.
  • Notice of Default is recorded and the borrower is given a deadline to repay what he/she owes or an opportunity to object. Texas law requires the servicer to send the borrower a notice of default and intent to accelerate by certified mail that provides at least 20 days to cure the default before notice of sale can be given. (from NOLO)
  • Notice of Sale: At least 21 days before the foreclosure sale, the servicer then sends a notice of sale to each borrower who is obligated to pay the debt. (from NOLO)
  • A Notice of Trusteee’s Sale is recorded and the auction is decided on.
  • Foreclosure sales are generally held the first Tuesday of each month between 10:00 a.m. and 4:00 p.m. at the county courthouse. The property will be sold to the highest bidder at the sale.

Commonly in many other States and occasionally in Texas the Judicial Foreclosure process is used.

Judicial Foreclosure:
  • A civil lawsuit is formed against the borrower.
  • Everything is handled by the legal court system.
  • A notice of pendency is performed.
  • The court agrees or disagrees on the lender’s decision of foreclosure.
  • The notice of sale is published.
  • The process takes from 4 to 8 months.
  • A deed of trust conveys an interest in real property to a third party to hold as security for repayment of a debt.

How to avoid foreclosure?

If you have current difficulty in paying your mortgage, contact your loan servicer immediately. Federal Deposit Insurance Corporation states that you have to make sure you work directly with your servicer or counseling agency. Offers which are too good to be true are usually a scam. Stay safe and trust only reputable services.

You should also carefully study your budget - track your expenses and see which spendings you can minimize.

How to get help from the government

U.S department of Housing and Urban Development presented several programs, implemented by The Obama Administration, which will help you avoid foreclosure. The list includes Making Home Affordable © (MHA) Program. Its strategy is to "help homeowners avoid foreclosure, stabilize the country's housing market, and improve the nation's economy." Companies like Federal Deposit Insurance Corporation also work towards helping you make easy and affordable repayments to your home.

Another way to avoid foreclosure is to sell it and get fast cash for your Houston house. We can make you a fair cash offer within 24 hours and close quick enough to beat the foreclosure sale date and save your credit and often times have you walking away with cash in your pocket!

Get a Cash Offer Within 24 Hours

In our experience with many clients we have helped, there simply isn't time prior to the foreclosure date to list your home with a real estate agent, show the house to potential buyers, negotiate, have inspectors and appraisers evaluate the home and then hope that the end buyer can get bank financing, and their current house sold in time to complete the purchase of your home before it's too late. In fact, we have seen many unfortunate people who were unable to stop foreclosure lose their homes because their realtor had let them down or the interested potential retail buyer couldn't close fast enough due to issues getting a mortgage, or simply because they couldn't move fast enough.
